Acceptance of Terms

By accessing or using RepairOTG (repairotg.com and any related subdomains or applications), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree with any part of these terms, you must not use our platform. We reserve the right to update these terms at any time with notice provided via email or a prominent notice on our website.

Description of Service

RepairOTG is a marketplace platform that connects customers seeking device repair services with independent repair shops. We provide:

• A marketplace for discovering and comparing repair shops
• Booking and quote request tools for customers
• A dashboard platform for repair shop owners to manage their business
• Customer-facing storefronts for participating repair shops
• Ticket tracking and job management tools

RepairOTG acts as an intermediary between customers and repair shops. We are not a repair service provider and are not responsible for the quality, safety, or outcome of any repair work performed by listed shops.

User Accounts

To access certain features of RepairOTG, you must create an account. By creating an account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorised access to your account
• Accept responsibility for all activity that occurs under your account
• Not share your account credentials with any other person

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or present a risk to other users of the platform.

Repair Shop Partner Terms

Repair shops listed on RepairOTG ("Partners") are independent businesses and are not employees, agents, or contractors of RepairOTG. By listing on RepairOTG, Partners agree to:

• Provide accurate information about their services, pricing, and location
• Respond to customer bookings and quote requests in a timely manner
• Handle customer data in accordance with applicable privacy laws
• Maintain appropriate business licences and insurance
• Not engage in deceptive, fraudulent, or misleading practices
• Honour confirmed bookings and quoted prices

RepairOTG reserves the right to remove any Partner from the platform for repeated negative customer feedback, policy violations, or conduct that damages the reputation of the marketplace.

Bookings and Quote Requests

When you submit a booking or quote request through RepairOTG:

• Your contact and device information is shared with the selected repair shop
• The repair shop will contact you to confirm the booking or provide a quote
• RepairOTG does not guarantee that a shop will accept your request
• Pricing shown on storefronts is indicative; final prices are confirmed by the shop
• Cancellation and refund policies are set by each individual repair shop

Any dispute about a repair, pricing, or service quality must be resolved directly between you and the repair shop. RepairOTG may assist in facilitating communication but bears no financial liability for the outcome of any repair.

Intellectual Property

All content on the RepairOTG platform — including the logo, design, software, text, and graphics — is the property of RepairOTG Ltd or its licensors and is protected by New Zealand and international intellectual property law. You may not reproduce, distribute, or create derivative works from our content without express written permission. Repair shop partners retain ownership of their own logos, images, and content uploaded to the platform, but grant RepairOTG a non-exclusive licence to display that content within the platform.

Prohibited Conduct

You must not use RepairOTG to:

• Submit false, misleading, or fraudulent bookings or reviews
• Harvest contact details of repair shops or customers
• Attempt to bypass or circumvent platform security measures
• Introduce malware, viruses, or other harmful code
• Infringe the intellectual property rights of RepairOTG or third parties
• Use automated scraping, crawling, or data extraction without written consent
• Engage in conduct that harasses, threatens, or harms other users
• Violate any applicable local, national, or international law

Violation of these prohibitions may result in immediate account suspension and, where applicable, referral to law enforcement.

Limitation of Liability

To the maximum extent permitted by applicable law:

• RepairOTG is not liable for the quality, safety, or outcome of any repair performed by a listed shop
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability to you for any claim arising from use of the platform shall not exceed NZD $100
• We do not guarantee continuous, uninterrupted availability of the platform

Nothing in these terms excludes or limits liability for death, personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under New Zealand law, including rights under the Consumer Guarantees Act 1993.

Indemnification

You agree to indemnify, defend, and hold harmless RepairOTG Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the platform, your violation of these terms, or your violation of any rights of another party. This indemnification obligation will survive termination of your account or these terms.

Governing Law and Disputes

These Terms & Conditions are governed by the laws of New Zealand. Any dispute arising from your use of the platform that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the New Zealand courts. For disputes of low monetary value, you may also access the Disputes Tribunal. We encourage you to contact us at support@repairotg.com before initiating any formal proceedings.

Termination

You may close your account at any time by contacting us at support@repairotg.com. We may terminate or suspend your access to the platform immediately, without prior notice, if you breach these terms. Upon termination, your right to use the platform ceases. Provisions of these terms that by their nature should survive termination — including intellectual property, limitation of liability, and indemnification — will remain in effect.

Changes to These Terms

We may revise these Terms & Conditions at any time. When we make material changes, we will notify you by email or by displaying a prominent notice on the platform. Your continued use of RepairOTG following the posting of changes constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you should stop using the platform and close your account.
